These Terms and Conditions (“Terms”) constitute a binding agreement between you (“Customer,” “you,” or “your”) and EnduranceBox LLC (“EnduranceBox,” “we,” “our,” or “us”) regarding your access to and use of our website, subscription services, products, and related offerings. By using our website or subscribing to EnduranceBox, you agree to be legally bound by these Terms. If you do not agree, do not access or use our services.

1. Subscription and Billing Terms

1.1 Subscription Services

EnduranceBox offers a recurring subscription service delivering curated endurance products on a monthly basis. Subscription terms (monthly, quarterly, annual) are clearly stated at checkout.

1.2 Automatic Renewal

By purchasing a subscription, you authorize us to automatically charge your payment method on a recurring basis until you cancel. You will be charged on or around the same day each billing cycle unless otherwise stated.

1.3 Modifications to Subscription

We reserve the right to adjust pricing, features, and contents of our subscription plans. Notice will be provided at least 14 days in advance for material changes. Continued use of the service after such notice constitutes your agreement to the revised terms.

1.4 Cancellation Policy

You may cancel your subscription at any time by logging into your account. Cancellations must be made prior to the next billing date to avoid being charged for the following cycle. We do not offer refunds for partial billing periods or shipped boxes.

2. Product Disclosure and Disclaimers

2.1 Third-Party Products

EnduranceBox curates and distributes products manufactured by third parties. We do not manufacture or independently test the products included in our boxes. Product packaging, ingredients, and usage directions should be reviewed carefully before use.

2.2 Medical Disclaimer

EnduranceBox does not provide medical advice. The products and statements presented are not intended to diagnose, treat, cure, or prevent any disease or condition. Always consult with a qualified healthcare provider before using any dietary supplement, performance product, or nutrition aid.

2.3 Ingestion and Allergen Disclaimer

Products included in EnduranceBox may contain allergens such as dairy, soy, gluten, nuts, or other ingredients. It is your responsibility to check product labels and consult with a healthcare professional before use. EnduranceBox disclaims all liability for adverse reactions, injuries, or health issues resulting from the use or misuse of any products included in your box.

2.4 Use at Your Own Risk

You assume full responsibility and all risks associated with the use of any products or recommendations provided through EnduranceBox. We do not guarantee specific results or performance improvements.

3. Shipping and Delivery

We currently ship to addresses within the United States. Shipping dates and box contents may vary. We are not liable for delays or loss caused by third-party shipping carriers or factors outside our control. Damaged or missing items must be reported within 7 days of delivery.

4. Refund and Return Policy

Except as otherwise required by law, all sales are final. We do not accept returns or provide refunds for shipped boxes. If you receive a defective or incorrect item, please contact us at [insert email] within 7 days of delivery and we will, at our discretion, replace or credit the affected item.

5. Intellectual Property

All trademarks, logos, content, and materials displayed on the EnduranceBox website are the property of EnduranceBox or its licensors and are protected under U.S. and international intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

6. User Conduct and Acceptable Use

You agree not to:

  • Interfere with the operation or security of the site;

  • Violate any applicable laws or regulations.

EnduranceBox reserves the right to terminate access to any user in violation of these Terms.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENDURANCEBOX AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR PRODUCTS OR WEBSITE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ENDURANCEBOX IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless EnduranceBox and its affiliates from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of your breach of these Terms, use or misuse of our products, or your violation of any applicable laws or third-party rights.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Maricopa County County, Arizona, and you consent to personal jurisdiction and venue in those courts.

10. Age Restrictions

You must be at least 18 years of age to subscribe to or use EnduranceBox. By subscribing, you represent and warrant that you meet this requirement.

11. Modifications to Terms

We may revise these Terms at any time. The updated Terms will be posted on our website with a new effective date. Your continued use of the service after such posting constitutes your acceptance of the revised Terms.
